Gay Politics Will Never Be the Same: Life After SONDA

New York, NY - December 25-31, 2002 ---- There was no photo op when George Pataki signed the state gay rights bill in the privacy of his office last week. It struck some activists as telling that the governor kept his promise to the gay community with such a lack of ceremony. But no one was in a mood to quibble. After a 31-year struggle, SONDA, the Sexual Orientation Non-Discrimination Act, was finally law.

Pennsylvania Passes Landmark Hate Crimes Law

Harrisburg, PA - November 26, 2002 - Today, at 8:45 p.m., the Pennsylvania House passed legislation to amend the state's Ethnic Intimidation Act by adding actual or perceived sexual orientation, gender identity, gender, mental and physical disability, and ancestry to the existing law. This legislation is believed to be the most inclusive language of any hate crimes bill in the country. The bill's passage was the result of a broad-based community effort from numerous organizations and individuals across the state strong bipartisan support from the leadership in the house

The bill won passage by a 118 to 79 vote after two hours of discussion. "We are all gratified to see that, for the first time in Pennsylvania's history Lesbian, Gay, Bisexual and Transgender people will be equally protected under the law," said Steve Glassman, SPARC's co-chair.

San Jose Approves Anti-bias Protections for Transgender People

San Jose, CA --- Nov. 27, 2002 --- Prompted by the recent slaying of a transgender teen in Newark, the San Jose City Council voted unanimously Tuesday to add transgender people to the list of groups protected under the city's antidiscrimination policy.

Councilman Ken Yeager proposed changing San Jose's harassment policy after learning about the beating death of Eddie Araujo.

Members of the Bay Area Municipal Elections committee, a gay and lesbian political advocacy group that Yeager co-founded in 1984, approached Yeager and Mayor Ron Gonzales about the amendment, which will add
protections for gender identity.

NY Gay Rights Bill In Trouble Over Excluding Transgenders

Albany, New York -- Nov. 27, 2002 -- Legislation to give New York gays and lesbians civil rights protections may not be passed this session after all. The Senate is to be recalled December 17 to consider the bill, a concession made by Senate Majority Leader Joseph Bruno in order to get a coveted endorsement for Gov. Pataki in the November election. But, opposition from TG groups may force the bill to be rewritten. As it now stands, the Sexual Orientation Nondiscrimination Act, (SONDA) does not mention the transgendered.

"Right now, SONDA protects one class of folks and leaves out another class that arguably needs more protection," said Michael Kink, legislative counsel of Housing Works Inc. Senate Minority Leader David Paterson, D-Manhattan says he might not support SONDA without an amendment.

NGLTF Lauds Chicago City Council for passing TG anti-discrimination measure

November 6, 2002, Chicago, Illinois - The Chicago City Council today voted to pass a measure amending the city's anti-discrimination laws to add explicit coverage for transgender Chicagoans. Mayor Richard Daley has expressed his support for the measure and is expected to sign it.

"Chicago activists have been working for many years on this effort. Adding protections based on gender identity and expression is simply the right thing to do and NGLTF calls on fair-minded jurisdictions across the country to do the same."

Cook County Board OKs Gender Identity Amendment

CHICAGO --- November 19, 2002 --- Today Cook County amended the County's Human Rights Ordinance to include the classification of Gender Identity. The vote came less than two weeks after the Chicago City Council passed a similar amendment by a 40 to 9 vote majority.

With a population of 5.4 million people, Cook County is the largest county in Illinois and one of the largest counties in the United States. The new law affects the nearly 2.5 million people who live within Cook County outside of the City of Chicago. The law makes it illegal to discriminate against a person on the basis of gender identity.

Baltimore City Council Passes Transgender Protections

Baltimore, MD --- November 25, 2002 ---- Baltimore City
became the first jurisdiction in Maryland to prohibit discrimination in employment, housing, accommodations, and credit practices based on gender identity or expression. The vote was unanimous among the 19-member Council without abstentions.

At an October 17th hearing convened by the Judiciary and Legislative Investigations
Committee, the committee heard testimony from 10 individuals in support of the bill. More than half of the testifiers were transgender people, who related their personal experiences of being the victims of discrimination.

Northwest Territories first in Canada to pass law prohibiting gender identity discrimination

YELLOWKNIFE, Northwest Territories --- November 5, 2002 --- The Northwest Territories has become the first region in Canada to prohibit discrimination on the grounds of gender identity.

As part of the territory's new Human Rights Act, a person cannot be discriminated against because of their gender identity.

Brendan Bell, the member of the legislative assembly who headed the committee that drafted the bill, said it seemed only logical to include gender identity in the new law.

Chicago anti-bias code to add transgender

CHICAGO, November 1, 2002 ---- Lorraine Sade Baskerville says there was a time when her presence as a transgender woman was enough to have her thrown out of public places, arrested and beaten.

More than two decades later, Baskerville witnessed the fruits of her struggle for acceptance and legal protection when the City Council's Human Relations Committee recommended adding language to the city's human rights ordinance that will protect transgender and transsexual Chicagoans from discrimination.

Chicago City Council Approves Gender Identity Amendment

CHICAGO, IL --- November 6, 2002 --- Today the Chicago City Council passed an amendment to the city's anti-bias laws that would protect the city's transgender and gender variant population by making it illegal to discriminate against a person on the basis of gender identity.

Aldermen Billy Ocasio and Bernie Hansen introduced the ordinance a little over two years ago. The ordinance passed City Council's Human Relations Committee last week with a unanimous vote. And today it passed City Council with a wide margin.

Three men arraigned in the death of transgender teen

NEWARK, CA, October 19, 2002 ---- The body of a transgendered Newark, California teen who failed to return home after an October 3 party was discovered nearly two weeks later, buried in a shallow grave 150 miles away. Seventeen-year old Lida (born Eddie) Araujo was found on Wednesday, October 15, after her mother reported her missing. Araujo was severely bludgeoned about the head, then strangled.

Police are currently investigating the murder as a possible hate crime. The National Transgender Advocacy Coalition (NTAC) strongly urges authorities to diligently prosecute and, if found guilty, to punish those responsible for this brutal killing to the fullest extent of the law. Late Friday, prosecutors charged three men in the murder.

Family, community bid farewell to killed transgender teen

NEWARK, CA, October 25, 2002 ----To family members, Gwen Araujo was a struggling but beloved teenager whose killing, allegedly committed in a fit of homophobic rage, is a private sorrow. To transgender activists, Araujo represents the 25th victim since last November, by their count, of violence against people who don't fit traditional gender molds. Both groups mourned Araujo at funeral services Friday.

"Angels don't have a gender and he's my angel now. I know that he's safe somewhere where no one can hurt him," said Araujo's mother, Sylvia Guerrero, speaking to hundreds of mourners at St. Edward's Church. ...

Boston City Council passes transgender anti- discrimination bill

BOSTON, October 23, 2002 ---- The Boston City Council today voted nine to one with one abstention to pass a measure adding gender identity and expression to the city's anti-discrimination law. In August, Mayor Thomas M. Menino indicated that he would support the measure if
passed.

According to National Gay and Lesbian Task Force (NGLTF) Executive Director Lorri L. Jean, "Boston is the eleventh city this year to demonstrate that when we educate legislators about the discrimination that transgender
people face, they will support laws that prohibit discrimination. Boston reaffirms its commitment to diversity and forward-thinking with the passage of this law."

Gender issue puts custody fight on new level

CHICAGO, Sept. 20, 2002 ---- Opening arguments were heard Thursday in a highly unusual child custody case in Cook County Circuit Court involving a 10-year-old boy, his mother who conceived him through artificial insemination by a donor and a father who is a transgender male.

The mother's attorney argues that because Illinois does not recognize same-sex marriages, the 42-year-old father, who was born a female but has been living as a male for 20 years, has no legal standing to argue for custody. But the father's lawyer contends that her client is a man and the union is valid.

HRC releases poll on transgender issues

WASHINGTON, Sept 30, 2002 ---- The Human Rights Campaign announced today the findings of a landmark HRC-commissioned poll that focuses on public perception of transgender issues. The poll shows that while most people accept that a person can be transgender, more education is needed to help people better understand the lives of transgender Americans, says HRC.

"The data shows that most people want to treat transgender Americans
fairly and protect them from workplace discrimination and hate crimes," said HRC Communications Director.

Decatur (IL) Ordinance passes 6-1

DECATUR, IL October 8, 2002 ---- The line of people who wished to speak to the Decatur City Council on Monday night stretched past the doors of the council chambers. More than 50 people spoke on an amendment to include sexual orientation in the city's unlawful discrimination code.

In the end, the ordinance was approved by a 6-1 vote ... making it illegal to deny someone such things as employment, housing, credit or public accommodations based on their sexual orientation [and gender identity].

Great News for Safe Schools from New Jersey

TRENTON, NJ, Sept. 6, 2002 ---- On Friday September 6th, Governor McGreevey signed A 1874 into law. This long awaited signing of a new anti-harassment bill was a great victory for safe school activists in New Jersey, as the legislation specifically includes sexual orientation and gender identity as distinctive protected categories.

This makes New Jersey only the third state in the country to explicitly protect transgender students.

Judge tosses Winn-Dixie trucker's case

NEW ORLEANS, Sept. 17, 2002 ---- On Monday, a federal judge in New Orleans dismissed the lawsuit filed by truck driver Peter Oiler against the Winn-Dixie grocery chain. Oiler worked for Winn-Dixie for 21 years before the company learned that he cross-dressed in his spare time. Oiler, a heterosexual who has been married since 1977, was immediately told to start looking for a new job, and he was fired a few months later, in January of 2000.
Brought by the American Civil Liberties Union nearly two years ago, the suit claimed primarily that Oiler's dismissal was a violation of Title VII of the Civil Rights Act of 1964...

Buffalo Extends Rights to TG and Intersexed

BUFFALO, Sept. 17, 2002 ---- Buffalo NY, known as the 'City of Good Neighbors,' proved its heart. In a near unanimous vote, the Common Council of the City of Buffalo extended protection against discrimination in employment and housing to transgendered persons. Mayor Anthony Masiello has announced that he will sign the amendments into law.

The amendments adding protection for "gender identity and expression" were initiated and sponsored by Councilman Antoine Thompson, who said, "It's another step to break from Buffalo's past and encourage tolerance and diversity."
